1. Introduction
Welcome to Tourmate360 ("Tourmate360", "Platform", "Service", "we", "us", or "our"). Tourmate360 is an online software-as-a-service (SaaS) platform designed to help bands, artists, venues, promoters, and other music industry participants manage touring activities, venue discovery, booking communication, and related organizational tasks.
By accessing or using Tourmate360, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

3. Eligibility
Users must be at least eighteen (18) years of age.
By creating an account, you represent and warrant that:
- You are at least 18 years old;
- You have the legal capacity to enter into binding agreements;
- All information provided is accurate and current.
Tourmate360 is intended for professional music, touring, booking, venue, and entertainment-related activities. Users may act as individuals, sole proprietors, businesses, organizations, or other entities.
Each user remains solely responsible for complying with all applicable tax, licensing, registration, employment, contractual, and regulatory obligations related to their activities.
4. User Accounts
Users must create an account to access certain features. Users are responsible for:
- Maintaining account security;
- Protecting login credentials;
- All activity occurring under their account.
Tourmate360 may suspend or terminate accounts that violate these Terms.
5. Account Types
Tourmate360 currently offers account types including:
Band Accounts
- Start
- Pro
- Agency
Venue Accounts
- Listing
- Booking
- Partner
Features and pricing may change from time to time. Tourmate360 reserves the right to modify, discontinue, or replace subscription plans.
6. Free Trial
New users may receive a fourteen (14) day free trial.
A valid payment method must be provided at registration.
Unless cancelled before the trial period expires, the subscription automatically converts into a paid subscription. Users authorize automatic billing upon expiration of the trial period.
No reminder notice is required unless otherwise mandated by applicable law.
7. Subscription Billing
Subscriptions are billed monthly through Stripe.
All prices are exclusive of VAT, sales taxes, and similar governmental charges unless explicitly stated otherwise. Users are responsible for any applicable taxes.
Invoices are generated electronically through Stripe.
8. Cancellation Policy
Cancellation requests submitted on or before the 15th day of a calendar month become effective at the end of that same month.
Cancellation requests submitted after the 15th day of a calendar month remain active through the following billing month and terminate at the end of that following month.
- No partial refunds shall be provided.
- No prorated refunds shall be provided.
Failure to use the Service does not entitle the user to any refund.
9. No Refund Policy
Except where required by applicable law:
- Subscription fees are non-refundable;
- Trial periods are non-refundable;
- Partial months are non-refundable;
- Unused subscriptions are non-refundable.
10. Public Profiles
Users may create public profiles visible to other users and visitors.
Public profile information may include:
- Name
- Band or Venue Information
- Biography
- Images
- Social Media Links
- Contact Information designated as public
- Website URLs
- Other information voluntarily provided by users
Users are solely responsible for information they choose to publish.
11. User Content
Users retain ownership of all content they submit.
By uploading content to Tourmate360, users grant Tourmate360 a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and process such content solely for the operation, maintenance, improvement, and promotion of the Service.
Users represent and warrant that:
- They own or control the necessary rights;
- Their content does not violate third-party rights;
- Their content complies with applicable laws.
12. Prohibited Content
Users may not upload, publish, transmit, or distribute:
- Illegal content;
- Fraudulent content;
- Defamatory content;
- Copyright-infringing content;
- Malware or harmful code;
- Harassing or abusive content;
- Spam or unsolicited advertising;
- Content violating privacy rights.
Tourmate360 may remove content at its sole discretion.
13. Messaging Services
Tourmate360 may provide internal messaging features.
Users are solely responsible for messages sent through the platform.
Tourmate360 does not monitor, verify, or endorse communications between users.
14. Venue and Booking Disclaimer
Tourmate360 is a communication and management platform only. Tourmate360:
- Is not a booking agency;
- Is not a promoter;
- Is not an event organizer;
- Is not an employer;
- Is not a contracting party between users;
- Is not a representative of any band or venue.
Offers, inquiries, requests, confirmations, discussions, negotiations, and communications conducted through the platform do not create contractual obligations involving Tourmate360.
Any agreement, booking, performance contract, payment arrangement, cancellation, dispute, or legal relationship exists solely between the participating users.
Tourmate360 assumes no responsibility for:
- Event cancellations;
- Non-payment;
- Performance quality;
- Venue conditions;
- Attendance levels;
- Safety issues;
- Contract breaches;
- Misrepresentations by users.
15. Third-Party Services
The Service integrates with third-party providers including:
- Stripe
- Supabase
- Vercel
Tourmate360 does not control third-party services and is not responsible for their availability, functionality, security, or actions. Use of third-party services may be subject to separate terms.
16. Affiliate Links and Accommodation Services
Tourmate360 may display affiliate links, including accommodation and travel-related offers.
Users acknowledge that:
- Bookings occur directly with third-party providers;
- Tourmate360 is not a travel agency;
- Tourmate360 is not responsible for reservations, pricing, availability, cancellations, refunds, or disputes.
Any transaction with a third-party provider exists solely between the user and that provider. Tourmate360 may receive affiliate commissions from qualifying bookings.
17. Intellectual Property
The Tourmate360 platform, software, branding, logos, design elements, databases, and related materials are protected by intellectual property laws.
Users receive a limited, non-exclusive, revocable license to use the Service. No ownership rights are transferred.
18. Availability
Tourmate360 does not guarantee uninterrupted or error-free operation.
The Service may be modified, suspended, or discontinued at any time.
Maintenance, technical issues, and third-party failures may affect availability.
19. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, Tourmate360 disclaims all warranties, whether express, implied, statutory, or otherwise.
20. Limitation of Liability
To the maximum extent permitted by law, Tourmate360 shall not be liable for:
- Indirect damages;
- Consequential damages;
- Lost profits;
- Lost bookings;
- Lost opportunities;
- Lost data;
- Reputational damage;
- Business interruption.
Tourmate360's total aggregate liability shall not exceed the amount paid by the user during the twelve (12) months preceding the event giving rise to the claim.
21. Indemnification
Users agree to defend, indemnify, and hold harmless Tourmate360 from any claims, damages, liabilities, losses, costs, and expenses arising from:
- User content;
- User conduct;
- Violations of these Terms;
- Violations of applicable laws;
- Disputes between users.
22. Termination
Tourmate360 may suspend or terminate accounts at any time for violations of these Terms.
Termination does not relieve users of outstanding payment obligations.
23. Governing Law
These Terms shall be governed by the laws of Spain.
24. Jurisdiction
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, except where mandatory consumer protection laws provide otherwise.
25. Changes to These Terms
Tourmate360 may update these Terms from time to time.
Continued use of the Service after updates constitutes acceptance of the revised Terms.
